TOZO.INC（US）and its affiliates (hereinafter referred to as "us" , “we” or "ours") fully protect and respect your rights to personal information. To explain how we will collect, use, store and protect your personal information and your rights,  we hereby formulate this policy for full elaboration. The relevant key points are explained as follows:

1. The business function of this product/service is to provide functions such as navigation, AI assistant, teleprompter, translation, messaging, scheduling, frequently used contacts, etc. for bound smart wearable devices and with bound smart wearable devices.

2. In order to ensure that you can fully use the product / service, we will inform and prompt you to consult this policy and relevant agreements in pop-ups and other prominent forms before your first use, and timely explain the relevant authority of our business functions and the purpose of the application authority. If you choose to refuse to grant or provide the necessary permissions or necessary personal information corresponding to the relevant business functions, we will regret that we cannot provide the corresponding functional services for you.

3. Please know that when you use this product / service for the first time, you agree that this policy and the corresponding authority do not mean that we have actually obtained the necessary authority, still less that we have begun to collect and process your personal information. It will still be possible to request you for the necessary permissions and process your personal information in a specific scenario. You can check and manage the relevant permissions in the application [My-Settings-Rights Management].

4. In addition to this policy, when you use the product / service, you may read the individual processing rules we have separately inform in the product / service. These individual processing rules are an important part of this policy. If there is any inconsistency with this policy, the individual processing rules shall prevail; if the individual processing rules are not agreed, this policy shall prevail.

5. For the important and sensitive personal information processing behavior involved in this policy and clauses or expressions that may significantly affect your rights and interests, we will use bold and other prominent forms. Please pay attention to reading.

6. If you have any questions about this policy, you can contact us through the contact information provided by the policy "9. Contact us" in this policy, and we will be very happy to answer them for you. We will also revise this policy from time to time based on laws, regulations and business changes, and inform you in accordance with the law.

Ⅰ. How do we collect and use your personal information

We will follow the national laws and regulations, abide by the legitimate, legal, necessary and good faith principle to protect your personal information, only for the following business functions and necessary purpose, and with your consent or comply with other legitimacy according to the laws and regulations, processing your restrictions under the purpose of personal information. You do not have to provide us with relevant authority or personal information, but in some cases, if you choose not to provide or grant, it may affect our corresponding business functions for you.

1. When you use our services with a AIVU account, we will collect and use your AIVU.INC（US）  account ID and account nickname, which are collected by our authorization from your affiliates indirectly. The purpose of collecting such information is to help you use our services through your AIVU account. Please read the Mobile account privacy agreement carefully before you register and log in to the Mobile account.

2. When you use the device connection service, we will collect use device Bluetooth Mac address, mobile phone model, device serial number, Android ID, custom device identifier, the information is you open the system after automatic collection or authorized by your authority through the third party indirect way, the purpose of collecting the information is to achieve glasses equipment found, binding and maintain the device with the application, in order to achieve more functions on the glasses. In this scenario, we may apply to you to authorize location (Android), Bluetooth (Android and iOS) to discover and bind devices via Bluetooth and WiFi. Personal information processing in this process is completed on the mobile phone, and will not be transmitted and saved to our server.

3. When you use the device display function on the home page, we will collect the connection status of your glasses and rings, the power, the name of the glasses, the volume and the brightness of the glasses. The information is automatically collected by the system. The purpose of collecting this information is to show the state of the bound device and provide the control function.

4. When you use glasses setting, we will collect your equipment related information (glasses name, model, firmware version, serial number), equipment setting items (including application list order, standby component layout, not disturb mode selection, automatic adjustment brightness selection, automatic screen setting and settings for controlling audio during screen off, wearing detection settings, network configuration), system language configuration information, positioning information. The purpose of collecting these information is to display the status of the bound device and control the related options of the device, as well as to automatically adjust the brightness according to your choice based on the local sunrise and sunset times obtained through the location information. At the same time, we bind the device information (glasses name, model, firmware version, serial number) to the AIVU account number that you log in, so as to synchronize your settings and provide a consistent experience.

5. When you view the weather information, we will collect and use your real-time temperature information, weather information, city information, date information, which is collected automatically through the system, and the purpose of collecting this information is to show the weather information. In this scenario, we may need to use the geographical location rights (Android system and iOS system). The weather information processed in this process is synchronized by the interconnection function of the mobile terminal, which is only processed locally and cached on the glasses terminal. We will not transmit and save it to our server.

6. When you view the real-time motion information using the AIVU system, We will collect and use your real-time step information and target step information on your mobile app, This information is collected by our indirect collection method from the mobile phone pedometer application with your authorization; When you view real-time motion information using iOS or other Android systems, We will collect and use your real-time step count information on your mobile app, This information is collected by your authorization to open health rights (iOS system) or indirectly collected from mobile sports and health applications (other Android systems). The purpose of collecting this information is to show you the number of moving steps on the glasses end. In this scenario, we may apply to your mobile phone to enable health rights (iOS) or indirectly collect your exercise steps (Android) from the mobile sports health app. The information processed in this process is synchronized from the interconnection function of the mobile terminal to the glasses, which is only processed locally and cached on the glasses end. We will not transmit and save it to our server.

7. When you use the translation function, we will collect and use the voice transcription results, the translation records (including the translation completion date, the translation text), and the user configuration data (including the font size of the subtitles) after you enable the simultaneous translation function. The voice transcription results and translation records (including the translation completion date and translation text) are collected by the system automatically (transmitted from the glasses end to this application); the purpose of collecting these information is to record the translation records and voice transcription records for the user to query relevant records in the application, and support the user to share translation records; the user configuration data (including subtitle font size) is collected through user's active submission, and the information is collected to display the AR subtitles on the glasses end according to the configuration set by the user. Personal information processing in this process is completed on the mobile terminal, and will not be transmitted and saved to our server.  

8. When you use the message notification mobile phone notification circulation function (i. e., the glasses display mobile phone received notice), we will collect and use your notification information, the information is you open permission through the system automatic collection, the purpose of collecting the information is to display and remind mobile phone notification information. In this scenario, we may apply to you to authorize notification use rights (Android and iOS) and application list rights (Android).

9. When you use the Wechat quick reply function of intelligent reminder, we will collect and use your notification information, which is collected through automatic collection by the system after you open the permission. The purpose of collecting these information is to support the quick reply to the mobile phone Wechat notification messages displayed at the glasses end. In this scenario, we may apply to you to authorize notification access (Android and iOS). Your notification information is only used for the glasses side display, and we will not store your notification information.

10. When you modify the notification switch setting in the message notification, we will collect and use your notification switch setting information. This information is collected by your active submission. The purpose of collecting this information is to record the switch, broadcast and automatic screen settings displayed by the mobile phone notification at the glasses end.

11. When you use the schedule function, we will collect and use your schedule information, which is collected through the system automatic collection after you open the permission. The purpose of collecting this information is to remind the recent schedule at the glasses end before the schedule begins. In this scenario, we may ask you to authorize reading calendar rights (Android and iOS).

12. If you have purchased a ring, when you use the ring management feature, we will collect and use your ring device information (including ring name, ring model, ring firmware version, ring Bluetooth address information). This information is collected automatically by the system. The purpose of collecting this information is to display the information of the bound ring device and to manage the ring device.

13. When you use the speech recognition function, we will collect and use your custom device identifier and recording data, which is collected through the user's initiative and the system automatically. The purpose of collecting this information is to distinguish the device and recognize the user's needs.

14. When you use the AI Assistant function, we will collect and use the following information:

(1) The information you input or enter, which is collected by the user voluntarily. The purpose of collecting these information is to provide voice interaction services.

(2) Your home address and work address, the information is collected by the user voluntarily. The purpose of collecting this information is to display multiple related navigation information at the glasses end according to the results of the voice assistant interaction, to help you view the planned path.

(3) When you use the voice call function, we will collect and use your contact data, the information is collected through the system automatically, the purpose of collecting the information is to help you in the glasses equipment call system, in the application with your voice command matching name and contact information, and will match the contact name and phone number to the glasses for you to choose, and received your selection results, help you to make the system telephone function. In this scenario, we will ask you to authorize the address book access (Android and iOS). Please rest assured that we will not save your contact data in the mobile phone terminal and server.

(4) Information about the city and precise location of your user. This information is collected through the initiative provided by the user. The purpose of collecting this information is to display the weather information of your location at the glasses end according to the results of the voice assistant interaction.

(5) Your alarm clock record, the information is collected by the user voluntarily. The purpose of collecting this information is to show the reminders you set up at the glasses end or help you set up reminders through the voice according to the results of the voice assistant interaction.

(6) Your Wechat address book information, which is collected by users voluntarily. The purpose of collecting this information is to display your Wechat information at the glasses end according to the results of voice assistant interaction, and help you complete sending Wechat and other functions through voice interaction.

(7) The user's click record, the information is collected automatically by the system. The purpose of collecting these information is to switch different display results information and complete the user's intelligent assistant function requirements.

(8) When you add, delete, change or check the calendar information of the mobile phone system through the voice instructions, we will collect and use your schedule content, date and time information, and the purpose of collecting this information will adjust the schedule information according to the results of the voice assistant interaction. In this scenario, we will ask you to authorize calendar rights (Android and iOS). The information displayed in the process of using the voice assistant is synchronized from the function modules of the mobile end to the glasses end. It will only be displayed locally at the glasses end. We will not save it to our glasses end and server.

15. When you use the real-world navigation function, we will collect and use your custom equipment identifier, precise location information, rough location information, route planning information, origin, destination, city, province, national region, coordinate system, license plate number, this information is provided by the user and system automatic collection, the purpose of collecting the information is used for positioning and navigation route planning. In this scenario, we may need to use geographic privileges (Android and iOS).

16. When you use the common address function, we will collect and use your home address, work address, this information is provided by the user actively, the purpose of collecting this information is to easily navigate to the home address, work address and navigation route planning.

17. When you use the software update, we will collect and use your mobile phone brand, mobile phone model, application name, application package name, application version number, system version and version number, device identifier, this information is automatically obtained through the system or application, the purpose of collecting this information is to detect and update the application.

18. When you use the firmware update, we will collect and use your glasses serial number, model, system version, storage space and power. If you buy the ring, we will collect your ring SN address, ring power, ring version, ring model, ring upgrade status information, this information is automatically through the system or application, the purpose of collecting the information is to detect and update firmware.

19. When you use the teleprompter function, we will collect and use your speech document information, configuration information (including the speech mode settings, notification switch information), the information is collected by your initiative, open permission through the system automatic collection, the purpose of collecting the information is to provide you with document import, select the speech document, and synchronize the speech document to the glasses end according to your setting rules show the speech document. In this scenario, we may apply to you to read the phone storage permission (Android11 below system version) or all file access permission (Android11 and above system version). Personal information processing in this process is completed on the mobile phone end and the glasses end, and will not be transmitted and saved to our server.

20. When you first use glasses to meet a specific time, we will collect and use your glasses SN number, FlymeAR system version number, glasses model, activation time, the information is collected through the glasses end and reported to the server, the purpose of collecting and storing the information is to record the activation of glasses equipment and calculate the number of activation. For the purpose of risk control, we need to check your device activation status every time you restart.date the firmware.

21. When you consult and choose to agree / reject / withdraw your consent to this policy in the interactive interface, we will collect and use your equipment information (variable Android ID) and log information (timestamp and corresponding system, application and protocol version information), which is collected by the system to comply with the provisions of laws and regulations, and you can effectively applicable version of this policy to protect your legitimate rights and interests.

22. In order to provide customer service or respond to your relevant requests, we may require you to provide or verify necessary personal information to ensure safe processing. For the purpose of contacting you, assisting you in solving the problem and results, we may collect the following information: contact information (your telephone number/email when you contact us), your communication information (including your text/picture/audio/call/record with us or related persons), and other necessary information (including account information, order information, other information that you provide to prove the relevant facts).

23. You agree that we may send you one or more types of notification, content and business information, such as message notification, identity verification, security authentication, and interactive information. But please rest assured, if you do not want to receive this information, you can unsubscribe through the way provided in the mobile phone SMS, and you can also contact us directly to unsubscribe.

24. In order to ensure the safety of the product/service according to the law, ensure your normal use of our products/services (such as implementing application updates and installations),  maintain the normal operation of the product / service, improve and optimize our service experience,  we will collect and use your device brand, device manufacturer, device model, terminal type, operating system, glasses device identifier (encrypted SN), mobile device identifier (Android ID), application information (application name, application package name and version number, Application running status and related event information), network access mode, account ID, system language and time zone, type and status, operation log and service log information, to understand the frequency of product/services, crash flash data, overall usage, performance data, and the source of the product. We do not associate and process this information with other personally identifiable information that you provide in your products and services.

25. In addition, according to the relevant laws and regulations and national standards, we may process your relevant personal information without your consent in the following circumstances:

(1) It is necessary for the personal information processor to perform his / her legal obligations or duties;

(2) It is necessary for the conclusion and performance of your contract as a party;

(3) It is necessary to deal with public health emergencies, or to protect the life, health and property safety of natural persons in emergency situations;

(4) Handle the personal information disclosed by yourself or other legally disclosed within a reasonable scope according to law;

(5) Other circumstances as stipulated by laws and administrative regulations.

26. Please understand, we provide you with business function is constantly updated and development, if a business function does not inform you of the processing rules for the collection and use of your information in the above description, we will inform you of information collection scenario, purpose, type and way, to obtain your consent or other legal processing personal information.

27. In order to ensure that you can normal or more convenient to use the product related business functions, we will obtain the necessary permissions of the terminal device system based on the system permission call rules after your authorization. Before applying, we will seek your consent, and you can choose to "agree" or "refuse" the permission application (as well as other types of permission control). After your authorization, we will open the relevant necessary permissions, and you can cancel the authorization at any time. Your cancellation of authorization will cause you unable to use the relevant business functions, but it will not cause you to use other business functions. Please be aware that in order to better protect the user rights of different system version, we will provide a specific system version users additional "empty information" (or similar expression) permission, after the user choose the permission, we only open the corresponding authority, but will not collect any personal information (i.e., empty data), so as to expand the relevant system version of optional permission.

Ⅱ. How do we entrust, share, transfer, and disclose your personal information

1. Entrusted processing and sharing

(1) In the implementation of the necessary personal information security impact assessment, we may entrust a third party such as the authorized partner to process your personal information in order to authorize the partner to provide certain services or perform functions on your behalf. We will sign the entrustment processing agreement with the agent or jointly abide by the relevant personal information processing rules, and clarify the rights and obligations of the specific purpose, period, processing method, personal information types and protection measures of the entrusted processing. The agent is obliged to process the relevant personal information within the scope of authorization and take relevant confidentiality and security measures to ensure the security of the personal information.

(2) Sharing means that we provide personal information to other personal information processors, and both parties independently decide the processing purpose and processing method in the personal information processing activities. Normally, we do not share your personal information externally, except where:

A. Sharing with a separate consent: After obtaining your separate consent, we will share the personal information within the scope of your authorization with a third party or our affiliates;

B. Sharing necessary for the performance of legal obligations or legal duties: We may share your personal information in accordance with the provisions of laws and regulations, litigation dispute settlement, or the requirements of relevant administrative and judicial organs;

C. Sharing with business partners: However, we will only share your personal information for legitimate, proper, necessary, specific and explicit purposes, and will only share the personal information necessary to provide the services. Our partners include:

a. Third-party sellers and third-party developers: Some products or services are directly provided to you by a third party, and we must share the information related to the transaction with a third party to realize your needs to purchase goods or services from them.

b. Suppliers of goods or technical services: We may share your personal information with third parties who support our functions, including third parties who supply or provide us with infrastructure technical services, logistics distribution services, payment services, data processing services, etc. The purpose of sharing this information is to realize the function of products and services, such as we must share your order information with the logistics service provider to arrange delivery.

c. Affiliate: In order to realize account login, software update and device connection services, we may need to share your personal information with our affiliates. For example, we must share the mobile phone model, device identifier, application name and other information with the affiliates that provide us with software update service to realize application upgrade; or our account service provider will directly collect your mobile phone number, password, device unique identifier (OAID, IDFV) to provide you with account registration, login and other account related services.

D. In order to facilitate you to have a clear understanding of the third party we entrust and share, we have specially made the List of Third Party Information Sharing.

2. Transfer

In the event of a transfer involving mergers, divisions, dissolutions, acquisitions, or being declared bankrupt, if personal information transfer is involved, we will inform you of the name and contact information of the recipient in advance and require the recipient to continue to process your personal information in accordance with this statement. If the receiver changes the original processing purpose and processing method, it shall obtain your consent again.

3. Public disclosure

We will publicly disclose your personal information only if:

(1) After obtaining your consent;

(2) Public disclosure based on legal or reasonable grounds: We may publicly disclose your information as required by law, legal procedures, litigation, or competent public and government authorities.

Ⅲ. How do we store your personal information

1. Storage location. In accordance with the provisions of laws and regulations, we will store your personal information in the domestic operation process collected and generated in the domestic server. If your personal information is transferred from China to abroad, we will strictly comply with the provisions of the law.

2. Storage period. Unless required by law or otherwise authorized by you to agree to a longer storage period, we will only store your personal information for the minimum time required to provide you with this product/service. When applicable, we will provide you with the relevant withdrawal of consent (cancellation) and deletion function according to the law. When you apply for the withdrawal of consent (cancellation) or deletion, we will delete according to the law, and the minimum necessary storage period will be at your discretion.

3. After the personal information collected and used exceeds the necessary storage period, we will delete or anonymize your personal information as soon as possible according to the requirements of laws and regulations, except as otherwise stipulated by laws and regulations.

4. The following is a fixed storage period: The consent and consent withdrawal records will be deleted within 13 months after you withdraw your consent.

Ⅳ. How to use Cookies, and other similar technologies

Cookie and similar equipment information identification technology is a commonly used technology in the Internet. When you use our services, we may send one or more Cookie or anonymous identifiers (hereinafter referred to as "Cookies") to your device to collect and identify information when you use the platform.

The main purpose of using Cookie is to ensure the safe and efficient operation of product functions and services, so that we can confirm the security status of your account and transaction, check the crash and delay, and help you skip the steps and processes of filling in the form and entering the search content, so as to obtain easier use experience. We undertake that we will not use Cookie for any other purpose other than the purposes stated in this Privacy Policy.

You can manage or delete Cookie based on your preferences. Most browsers provide users with the ability to clear browser cache data, you can clear Cookie data in browser settings, and you can clear all Cookie saved in the software. However, the functions or services provided by us and rely on Cookie may not be used after clearing.

Ⅴ. How do we protect your personal information

We attach great importance to the security of our personal information, and we adopt industry standard practices to protect your personal information from unauthorized access, disclosure, use, modification, damage or loss. To this end, we have specifically taken the following measures:

1. We take all reasonable and feasible measures to ensure that the collection of personal information is minimized and that personal information unrelated to the purpose is not collected. We will only keep your personal information for the period required to meet the purpose stated, unless the retention period is extended or permitted by law.

2. In order to ensure your information security, we strive to adopt various reasonable physical, electronic and management technical controls in line with industry standards to protect your information from being leaked, damaged or lost. These technical controls include, but are not limited to, HTTPS, encryption technology, deidentification, local storage and processing, and access control of data centers.

3. We will deploy access control mechanism to ensure that only authorized personnel can access personal information, and control the number and hierarchy; access to personal information is logged and regularly audited by administrators.

4. We will strictly select and authorize partners, and implement the requirements of personal information protection into the business contract, audit, assessment and other activities of both parties.

5. We will also hold security and privacy protection training courses, tests and publicity activities to enhance employees' awareness of the importance of protecting personal information.

6. We will do our best to protect your personal information. Nevertheless, no measures can be invulnerable, and no products and services, websites, data transmission, computer systems, and network connections are absolutely secure. In order to deal with the possible risks of personal information leakage, damage and loss, we have formulated a number of systems and control measures. According to the requirements of safety incident disposal norms, we start safety plans for different safety incidents, stop loss, analysis, positioning, formulate remedial measures, and backtracking and attack with relevant departments.

7. In the event of a personal information security incident, we will inform you as required by the law: the basic situation and possible impact of the security incident, the disposal measures we have taken or will take, the suggestions you can independently prevent and reduce risks, and the remedial measures for you, etc. We will inform you of the relevant situation by email, SMS and push notification, etc. When it is difficult to inform the personal information subject one by one, we will take a reasonable and effective way to issue the announcement. At the same time, we will also report the handling of personal information security incidents in accordance with the requirements of the local regulatory authorities.

Ⅵ. Your personal information subject rights

We respect your personal information subject rights, and fully protect your management and control of your personal information. To facilitate this, we provide you with a variety of ways to facilitate you to be more secure, more convenient for privacy settings and personal information management, to ensure your personal information security. The following lists your legal rights and tips how we will protect your rights.

Please note that for security reasons, we may need to verify your identity before processing your request; operational settings may vary between different products/services, operating systems, and product software; and we may adjust specific operational settings to optimize your experience.

If this product/service provides AIVU account service, you can realize convenient personal information management by logging in to AIVU account.

Your rights to your personal information are as follows:

1. Check, correct and supplement your personal information

(1) Access: You have the right to know and check how we deal with your personal information. In order to improve the transparency of personal information processing, we have issued this policy. In this product/service, you can view the privacy policy and related rules by checking the pop-up statement of the product/service, through [My - Settings - About]; you can also consult the personal information we may collect and process through [My - Settings - Account Center] or [My-Settings-List of Personal Information Collection], [My - Settings-List of Third Party Information Sharing].

(2) Correction, Supplement: If you find that the personal information we handle about you is inaccurate or incomplete, you have the right to ask us to correct it in time, and, where appropriate, ask us to complete the correction of your personal information. For part of your personal information, you can directly correct and supplement in the corresponding access interface. In order to ensure the quality of personal information and avoid the adverse impact on your personal rights and interests due to inaccurate and incomplete personal information, we may need to conduct necessary verification of your identity before you implement corrections and supplement.

2. Delete your personal information

(1) In any of the following circumstances, we will actively delete your personal information, or you can make a deletion request to us:

A. The processing purpose has been realized, it cannot be realized, or it is no longer necessary to realize the processing purpose;

B. We stop providing our products / services, or the storage period has expired, for example, you have no longer used our products / services;

C. You have withdrawn your consent;

D. We deal with your personal information in violation of laws, administrative regulations or agreements;

E. Other circumstances as stipulated by laws and administrative regulations.

(2) Please understand that when you request the deletion or anonymization of your information, if we may not be able to immediately delete it from the system due to applicable legal and security technology restrictions, we will securely store your personal information and restrict any further processing of it until it can be deleted or made anonymous.

(3) In a specific product/service, you can delete it directly from the relevant function page.

A. Enter [Glasses Settings] on the application home page, click "Restore Factory Settings" to delete all the data of the bound device;

B. After entering [Glass Settings] on the application home page, click "Unbind" to unbind the device. Note that only the unbound device will not delete the data of the relevant device. If you need to delete all the data of the bound device, please choose to restore the factory setting;

C. Enter [Translator] on the application home page, you can view the voice transliteration records and translation records through all the records. After clicking the specific record, the record can be deleted through the deletion function in the upper right corner.

D. Enter the [Teleprompter] on the front page of the application to view the current imported speech documents, and delete the document data imported by the user by restoring the default document in the [Teleprompter-Speech Settings].

3. Copy and transfer your personal information

(1) You have the right to copy your personal information. You can claim the right of replication through [Ⅸ. Contact us], and we will continue to optimize the implementation of the right of replication according to the technical capabilities.

(2) On the premise that you meet the conditions stipulated by the relevant national departments, if you request to transfer your personal information to the personal information processor designated by you, we will realize the transfer.

4. Make a complaint or to obtain an interpretation

You have the right to contact us and make a complaint and seek assistance through the information disclosed in this policy. If you are not satisfied with our answer, especially our personal information processing behavior has damaged your legitimate rights and interests,  you can also complain or report to regulatory authorities such as the Cyberspace Administration, Public Security, and Industry and Commerce, or file a lawsuit with the court with jurisdiction.

5. The rights of the close relatives of the deceased

If you pass away, if you fail to inform us of other arrangements in writing or by other reasonable means, your close relatives can contact us based on their own legitimate and rightful  interests to obtain relevant guidelines to exercise the rights of inspection, copying, correction, deletion and so on as stipulated by law.

6. Account Cancellation

(1) When you use the AIVU account service, you can apply for the cancellation of your AIVU account through [My-Settings-Account and Security-Account Cancellation]. In order to ensure that you or an authorized applicant to apply for cancellation of your account, we and our affiliates will collect and verify the identity information of you and the applicant and do our best to protect your rights and interests.
